By accessing the Site or viewing any reports or notifications made available through your user account, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you are acting on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
Live Guard Tech reserves the right to update, modify, or replace any part of these Terms at its sole discretion. Updates will be effective immediately upon posting to the Site. Your continued use of the Site constitutes acceptance of those changes.
2. Services Provided
Live Guard Tech offers remote video monitoring, incident detection, and security reporting services for commercial and residential sites.
The Site is used as a secure portal where authorized users may access incident reports, monitoring notices, and relevant alerts associated with a jobsite or client account. The Site does not allow general public access or user-generated content.
Users may only view content uploaded by Live Guard Tech and may not edit, alter, or upload content themselves.
3. Account Access and Responsibilities
To access jobsite-specific content, Live Guard Tech may provide you with a user account and login credentials.
By using your account, you agree to:
Keep your username and password confidential and secure
Notify us immediately of any unauthorized access or suspected breach
Use the Site only for purposes directly related to your contract or jobsite
Ensure that any personnel accessing the account on behalf of your company are authorized and understand these Terms
Live Guard Tech is not responsible for any unauthorized use of your account resulting from your failure to secure your credentials. We reserve the right to disable or revoke account access at our discretion if misuse, inactivity, or a breach of these Terms is detected.
4. Content Ownership and Permitted Use
All notices, incident reports, videos, and documentation provided through your user account remain the exclusive property of Live Guard Tech or its licensors. These materials are protected under copyright, trade secret, and intellectual property laws.
You are granted a limited, revocable, non-transferable license to access and view these materials solely for internal use related to your monitored sites.
You may download or print content for legal, operational, or insurance purposes, but you may not:
Reproduce or distribute the content for unrelated third-party use
Modify, reverse-engineer, or tamper with the content or its metadata
Share materials in a misleading, defamatory, or harmful manner
Any unauthorized use of content may result in legal action and account suspension.
5. Service Availability and Technical Limitations
While Live Guard Tech endeavors to maintain uninterrupted access to the Site and deliver timely notifications, you acknowledge that service availability may be affected by:
Routine system maintenance or software updates
Unforeseen technical errors or outages
Power or internet interruptions at the client or server end
Cybersecurity threats or compliance obligations requiring temporary access restriction
We do not guarantee uptime, real-time access to reports, or the timeliness of file uploads. In the event of an outage, we will take commercially reasonable steps to restore access but will not be liable for missed updates or resulting delays in your operations.
6. Data Privacy and Confidentiality
We take the protection of your data seriously. Information accessed through the Site may include, but is not limited to:
Video footage, sensor logs, and visual evidence related to incidents
Names, contact details, and jobsite-specific information
Timestamps, device logs, and response notes from our monitoring team
By using the Site, you agree to our Privacy Policy, which outlines how we collect, store, and use your data in compliance with applicable laws.
Confidentiality
You agree to:
Treat all downloaded or accessed reports, video footage, and notifications as confidential
Limit access to such information within your organization to authorized personnel only
Refrain from disclosing confidential information to third parties unless required by law or with written consent from Live Guard Tech
Live Guard Tech uses commercially reasonable safeguards to protect your data, including encryption, secure user access controls, and routine system monitoring. However, no system is completely immune to compromise, and we cannot guarantee absolute security.
7. Prohibited Uses
You agree not to use the Site or any part of the services to:
Interfere with or disable Site functionality or security
Attempt to gain access to other users’ data or accounts
Extract, copy, or scrape data using automated tools or bots
Misrepresent your identity, affiliation, or authority

9. Limitation of Liability
To the fullest extent permitted by law, Live Guard Tech and its affiliates, employees, and agents shall not be liable for:
Any indirect, incidental, special, punitive, or consequential damages
Loss of data, business disruption, or reputational damage
Delays in report uploads or service interruptions
Our total liability for any claims arising under these Terms will not exceed the amount paid by your company for the relevant monitoring service in the 12 months preceding the event giving rise to the claim.
10. Termination of Access
We reserve the right to disable or terminate your account access:
If you breach these Terms
Upon the expiration or cancellation of your service contract
If required by law or to protect the integrity of the system
Upon termination, you will lose access to your reports and historical data, except where retention is required by law or contract. You may request a final download of materials in writing within 10 business days of termination.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
Any disputes or claims arising out of or relating to these Terms or use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in Arizona.
12. SMS Notifications
As part of our service, Live Guard Tech may offer optional SMS (text message) notifications to inform users of critical incidents, monitoring events, or report uploads.
Opt-In: You may opt in to receive SMS alerts by providing a valid mobile phone number and explicitly consenting via account settings or written authorization.
Opt-Out: You may opt out of SMS notifications at any time by updating your communication preferences in your account, contacting our support team, or replying "STOP" to any SMS received.
Standard messaging and data rates may apply as determined by your mobile carrier.
SMS notifications are provided as a courtesy and are not guaranteed to be timely, uninterrupted, or error-free. Live Guard Tech shall not be liable for any issues arising from SMS delays or failures.
